Drug registration is a registration that is carried out at a drug dispensary at your place of residence.

Registration means that a person has been recognized as an alcohol or drug addict, and such a citizen is partially deprived of his rights. After all, drug registration is not a voluntary and not very pleasant measure, but it is very useful.

Registration:

• Accounting is control over a problem that is associated with alcohol or drugs, is of great importance in the country's strategy and is the prevention of alcoholism and drug addiction, treatment of addiction on a mental or physical level.
• Registration is treatment at the expense of the state in medical institutions, under the supervision of qualified doctors.
• Registration at a dispensary - exempts a person from military service on a legal basis. For some people and parents this is a big plus. But parents are different, they can deliberately send them to serve in the army so that their child stops dabbling with alcohol or drugs.

Drug registration: terms and types

Preventive accounting is based on the observation of patients whose dependence on alcohol or drugs has not yet been fully formed. For this species, the observation period is approximately one year. It is quite easy to register with such a register, and it is much faster to remove yourself from it than from a regular dispensary.

Dispensary registration - they diagnose a person who already has an established diagnosis of addiction. The terms here are already more serious, about 3 years for a person with alcohol addiction and up to 5 years for a person with drug problems. You can reduce the accounting time according to the rules, a meeting of the doctors’ commission.

Preventive accounting

If a person is admitted to the dispensary who has been found to be using narcotic substances, or is often found to be drunk, then such a person is placed on a preventive register. After all, with some narcotic substances, the effects on the body may not immediately appear, so such a patient is monitored. This is for if the patient has not yet been diagnosed.

The narcologist observes such a person for exactly 1 year. This means that under good circumstances, deregistration will occur exactly in a year, but if the tests show a negative result, then the patient will be transferred and you will be asked to take a more strict one.

Dispensary registration

People are placed on such a register when a diagnosis of alcoholism or drug addiction has already been fully formed. An alcoholic will be monitored for 3 years, while people who have drug problems will be monitored for about 5 years.

The patient undertakes to regularly visit the doctor and undergo periodic tests. And there is only one way to be removed from such a register quickly, this is only a prison sentence, soon more than 3 years.

Anonymous surveillance

This is for those people who themselves sought medical help. They want to cure their addiction without anyone knowing about their treatment or problem. In this case, all information about the patient will be stored only by the attending physician. The information will not be entered into various databases and will not be transferred to anyone.

The patient will have all the rights, he will not be limited in anything, for example, he will be able to drive a car. A person who is registered on an anonymous account is not required to go regularly, go for various tests or visit a doctor (when the patient wants, then he can come).

There is one drawback to this type of accounting - it is paid. The treatment period is already drawn up during the course of treatment.

Types of dispensaries

There are different types of dispensaries in Russia, such as:

Dispensary structure

Who makes the decisions—the drug treatment clinic?

Of course, all important questions and decisions are made by your doctor, a narcologist. He has no reason to keep you on the register any more than necessary. It will be better for the doctor if I remove you an order of magnitude earlier than necessary. After all, this will show that the doctor’s treatment is effective.

But the person who manages the entire department is responsible for registration at the dispensary. There is one point in his powers: he can assemble a commission, if there are reasons for this, which will decide the future fate of the patient. The commission can remove the patient from the register if he has success or simply shorten the period.

Negative aspects of dispensary registration

When a person is admitted, he is registered, and he is then officially considered sick and certain restrictions begin to apply to him, most of all these restrictions relate to human activities.

The person who has been registered is not allowed to:

• places where there is a high risk of fires or working with explosives;
• the person is unable to obtain a driver’s license or drive a car;
• It is not allowed to work as an electrician;
• work in the subway and with other types of trains.

The most important thing of any accounting is regular visits to your doctor. How often to go depends on how long your periods of sobriety are. Longer duration means fewer visits. But at the beginning of treatment, 6 months, you will have to visit the doctor at least once a month.

Some good private companies, when hiring, may ask for a certificate from a drug treatment clinic, and such a certificate can only be obtained when the patient is completely healthy and deregistered. A certificate may also be required when obtaining a visa.

If you are not registered, there is also no reason to get it quickly. Now it is mandatory for any citizen to undergo a medical examination to obtain this certificate. And if you do not have any problems with this, then it will be given to you in the near future.

Drug registration: useful points

Consequences that are possible after taking into account

After you have undergone treatment and rehabilitation, you will be deregistered, unless, of course, you have given up alcohol or drugs. All the data that you were registered will not appear anywhere, and you will be given all the certificates, stating that you have never been addicted to anything.

How deregistration occurs

If you are detained by the police for drunk driving, then you need to contact a lawyer or undergo all the necessary treatment, taking into account the rules and procedures and the person will undergo drug registration within this time:

• unformed alcoholism - one year;
• alcoholism - 3 years;
• taking narcotic substances - 5 years.

• a duplicate of the card of the person who was registered;

It sometimes happens that the state asks you to provide a certificate from a drug dispensary to find out whether you are registered. And often everyone is sure that it will be quick, but it turns out that you cannot get it due to the fact that you are registered.

What should be done in such cases?

There are two solutions here:

• Complete the entire course of treatment according to the rules, take various tests, visit a hospital employee, for about a year. After which you go through a commission and receive the necessary certificate and are deregistered.
• Contact a law firm. Experts will check whether the procedure was legal; all actions of doctors are regulated by the legislation of the country. Most of it is in Chapter No. 704 dated September 12, 1988, where the main periods for observing a person are indicated. The lawyer will have to submit a representation to the judicial authorities, if later the doctor’s mistakes are revealed, it will be possible to legally be removed from the register.

There are often violations in this area, and for this it is necessary to raise the question of whether the registration was legal. And without a lawyer, deregistration is almost impossible, since ordinary people do not know the laws well.

List of professions where it is necessary to present a certificate from a drug treatment clinic

The Law of the Russian Federation of April 28, 1993, Chapter No. 377 “On assistance to citizens with psychiatric treatment” consists of the following professions:

• when working or producing benzene;
• a profession that has a relationship with drugs;
• work that relates to oil or other carbohydrates;
• pharmaceutics and pharmacology;
• working with explosives;
• work where weapons are used or carried;
• in rescue services;
• work as a fireman;
• driver of any type of transport;
• operation and maintenance of various trains.

In principle, most of these restrictions are justified. But it often happens that deprivation of some civil rights affects people who do not have an addiction, who have not taken drugs or alcohol for a long time but still remain registered because they do not have the opportunity to visit a doctor often.

And parents who are registered often encounter a problem such as deprivation or at least restriction of parental rights (Article No. 69 and No. 73 - Family Code of the Russian Federation).

It happens that such threats cannot always satisfy or meet the interests of the child, what can we say when a certificate from the clinic is considered the main argument or the only document for removing guardianship. And our court, in almost all such cases, makes a unanimous decision to remove custody of the child.

Accounting at the dispensary is governed by the following laws:

• General Order from the Ministry of Internal Affairs and also the Ministry of Health of the USSR dated March 20, 1988 No. 402/109 “Instructions have been approved on how to identify and register people who use narcotic or similar drugs for non-medical purposes, register and referral for treatment is compulsory.”

Before the changes adopted at the end of 2016 to the procedure for passing a medical examination to obtain a license, it was much easier for drivers to obtain a medical certificate.

Before the adoption of these changes, a candidate for a license could bypass everyone as a doctor in one clinic (private or public, at the driver’s choice), including a psychiatrist and narcologist.

Now, as many drivers are already aware, in order to obtain certificates from these doctors, you must visit a drug treatment and mental health clinic (and only state-owned; private clinics are not allowed) strictly at your place of registration.

Certificate No. 089/083-u has also undergone changes, the format has changed, it has become colored, and most importantly, there have been changes in the rules for filling it out and the type of information entered. Examination procedures in drug treatment and psychodispensaries

As mentioned above, after changes were made to the law on passing a medical examination to obtain a driver’s license, examinations by a psychiatrist and a narcologist are carried out exclusively in state dispensaries. The relevant doctors are personally responsible for the results of these examinations (administrative liability has been introduced for incorrect diagnosis).

Both before and after the changes, a narcologist and a psychiatrist are required doctors to undergo a medical examination for a driver’s license. You must pay for your appointment from your own funds. When going to a psychiatrist or narcologist, a man only needs to take his passport and military ID (or registration certificate), while women only take their passport.

So, an examination by a psychiatrist is carried out at the state psychodispensary at the place of registration. For some categories of rights (“B”, “C”, “D” and their subcategories), it is also necessary to do an EEG of the brain. It is done there and on the same day.

In addition to a visual examination and questioning, a citizen must submit his urine for analysis to detect traces of drugs in the body, and also undergo the procedure of taking the “Shulge test.”

Since an examination by a narcologist is required to obtain a license, citizens registered at a drug dispensary will not be able to satisfactorily pass the examination, and therefore will not be able to obtain a license.

Is it possible to undergo a medical examination to obtain a license if a citizen is under supervision at a drug dispensary?

As everyone knows, citizens registered at a drug dispensary will not be able to obtain a license, since they simply will not pass the mandatory medical examination. In order for a person registered at a drug dispensary to have the opportunity to obtain a license, he must first be removed from this registration.

And in order to be deregistered, a citizen must abstain from using drugs and alcoholic beverages for a sufficiently long period of time. This must be confirmed by the narcologist who is seeing the citizen, and then by a special commission that decides whether or not to deregister the citizen based on the narcologist’s observations.

The commission consists of doctors from the dispensary where the citizen is being observed. To be able to collect a commission and deregister, a citizen must not use drugs or alcohol for 5 years in a row, and regularly check in with a doctor to record this period.

If there are breaks in the marks, the continuous period will not be counted and will be extended.

Those citizens who have at least once passed a positive medical examination for drugs or alcohol are already registered, although not everyone knows about it. And they are confronted with this fact when they need to get a medical certificate again (replacement of license, return after punishment, etc.).

These citizens will definitely not pass the medical examination, since they will not be given a certificate from the drug dispensary.

They have 2 options: either wait 5 years until they are deregistered (regularly checking in with a doctor), or ask for an urgent medical examination, according to the results of which the citizen can be deregistered early.

In what cases is a mandatory medical examination carried out?

There are cases when a driver is forcibly sent for a medical examination to determine the presence of alcohol or drugs in the body. In such a development of events, a protocol must be drawn up, where a note about compulsory medical examination is made. Typically, compulsory medical examination is sent in the following cases:

• If the driver categorically denies the results of previous alcohol and drug tests;
• If the driver does not want to undergo a medical examination for the presence of alcohol and drugs in the body;
• If the driver is at fault for the accident;
• There are all the signs that the driver is drunk;

If there is one of the above signs, the traffic police officer looks for 2 witnesses and, in their presence, draws up an act of referral for a compulsory medical examination.

One copy remains with the traffic police officer, one is given to the driver, after which it is delivered to a medical facility.

If the driver refuses a voluntary examination, a note to this effect is made in the report and certified by witnesses.

The medical examination procedure for the presence of alcohol or drugs is carried out by a doctor who has undergone appropriate training. In the event that a medical examination and relevant tests do not reveal any prohibited substances in the driver’s body, the traffic police inspector takes the driver to his car.

For any result of a medical examination, a protocol is drawn up where the results are recorded. This protocol is valid for 3 years. The conclusion after the medical examination is drawn up by the doctor who conducted it. If prohibited substances are found in the driver’s body, their name is not written in the report.
